Terms and Conditions of Membership

By purchasing a South East Melbourne Phoenix membership you agree to be added to the South East Melbourne Phoenix electronic database, which is maintained by RC Aussie Hoops Pty Ltd (ACN 619 010 285) as trustee for RC Aussie Hoops Unit Trust (ABN 59 646 069 941) (‘SEMP’). By doing so you agree to receive information, offers and special promotions regarding SEMP.

Furthermore, you agree for SEMP to disclose your personal information you provide to us to third parties associated with SEMP so they can contact you for the purposes set out in this document and any services, offers and special promotions they may have available to SEMP Members.

Should you not wish to receive any of this information or offers, or should you not wish for your personal information to be disclosed by SEMP to third parties please notify us in writing to PO BOX 9019, SCORESBY, VIC 3178 or membership@semphoenix.com.au with a request to opt out or unsubscribe.

Privacy

SEMP may seek and collect personal information, including sensitive information (as those terms are defined in the Privacy Act 1988 (Cth) about membership holders in accordance with the Privacy Policy. SEMP may use and disclose personal information for the purposes set out in the Privacy Policy.

Membership type

  1. Junior Policy

All members aged under 16 as at 01/01/2024 will be classified as a junior.

  1. Concession Policy and Companion Memberships

To qualify for a concession membership, members must hold one of the following forms of concession ID for the duration of the NBL Season, including Finals: Pension card, Full-time Student card, Senior’s card, Veteran’s Affairs card, Disability card or Carer’s card. Members must produce their concession ID on game day when entering the venue with their membership card. If a member is no longer entitled to a concession card the member must contact the club on 1800 Phoenix (746 364) and update their membership to an adult membership.

Members holding a Health Care card are not eligible for a concession membership.

Members holding a Companion card will be entitled to an additional complimentary membership for their Companion to use to attend with the member on game days. Upon application of a Companion membership the Companion card number must be supplied.

  1. Family Policy

SEMP Family Memberships are for two adults and up to two junior members. Additional junior memberships can be purchased at the normal junior membership price per category.

Access to games as a member

Full season SEMP members receive access to all home games played across John Cain Arena or any other SEMP home game venues as may be determined by the NBL (subject to capacity at the relevant venue). For home games played at John Cain Arena, simply scan your membership card at the turnstiles and enter the arena. Five-game adult members receive access to five home games (subject to capacity at the relevant venue).

  1. Reserved Seat Members

Reserved seat members are guaranteed their admission based on their seat allocation for home games at John Cain Arena. For home games played at other venues, reserved seat members will be required to redeem a seat through the ticketing agent at no cost. Reserved seat members will not be able to scan their membership card at such venues to attend these matches.

  1. 6th Man Members

6th Man members will be required to redeem their general admission seat at any home game venue other than John Cain Arena through the ticketing agent.

By purchasing a 6th Man membership, you acknowledge that access to games is not guaranteed at all venues. Access is subject to capacity and 6th Man members must redeem a seat in order to guarantee entry, particularly to blockbuster games and games played at any home game venue other than John Cain Arena. Additional fees and charges are to be paid directly to the ticketing agent when reserving a seat.

  1. Supporters Package Members

Members with the Supporters Package will not have access to any home games, without purchasing tickets which these members will receive a discount on for all home games.

Members with the Supporters Package will have access to interstate away game tickets when available, however this is not guaranteed as tickets can only be provided when available. To inquire about tickets to away games, please contact our membership team at membership@semphoenix.com.au.

SEMP may decline to accept an application for membership in its absolute discretion. If SEMP declines to accept an application and the membership fee (or part thereof) has already been processed, SEMP will refund the fee.

Membership Transfer Policy

Members can transfer their membership to another person such as a friend or family member (‘Transferee’) to use on game days by allowing the Transferee to use their membership card, so long as the Transferee using the membership card falls under the same category as the member – i.e. a child using a junior ticket, a patron using a concession membership must show proof of concession etc,  or pays to upgrade the membership admission on game day (as set out below).

Members transferring a membership to another person do so at their own risk that the membership card is not returned to them and can be used again by the person possessing the card.  Members are responsible for their membership card being returned to them by the person possessing the card (and SEMP is under no obligation to issue a new card to a member whose membership card is not returned).

Member’s Rights and Responsibilities

You acknowledge that when purchasing a membership, you may be doing so before the release of the relevant season’s fixture with the dates and times of the games not yet determined. Subject to the refund policies described below, no refunds will be offered where members are unable to attend games, including due to a conflict in scheduling.

Members are encouraged to support our team at every opportunity and member support is a vital part of our team’s success. Offensive and aggressive language and behaviour is not in the spirit of basketball and will not be tolerated in any way. On game days, at events and functions and via social media, members may not engage in or endorse any form of threatening conduct, vilification or abuse on the basis of race, gender, religion, disability or sexuality.

Members acknowledge that they will comply with the behaviour code of conduct as a condition of their membership. SEMP members who breach the behaviour code of conduct may face penalties including (but not limited to) immediate membership cancellation without refund. SEMP management reserves the right to support police investigation of members breaching the code of conduct where appropriate.

NBL24 Membership Refund Policy

Subject to any rights the membership holder may have under the Australian Consumer Law, once a membership has been purchased, SEMP will only provide a cancellation, refund or credit as set out below, or otherwise in exceptional circumstances in its sole discretion. All applications for refunds or credits are to be made in writing and addressed to:

Membership Refund/Credit Policy – should NBL24 not go ahead

If due to any reason (e.g. Covid-19) that the Hungry Jacks 2023/24 NBL season ('NBL24 season') is cancelled entirely before the first game of the NBL24 season is played, members who have purchased their SEMP membership for the NBL24 season will be entitled to a refund or credit of all monies paid, less an administration charge of up to $20 for single membership or $50 for a family membership, provided they complete and return to SEMP, prior to 30 May 2024, a refund/credit application form (which form will be made available at www.semphoenix.com.au.) This includes a refund/credit of partial payments made via the Phoenix Flex Payment Plan.

At the time of applying, members will be given the option of receiving a refund or having the relevant amount credited towards future membership fees.  Members may also be given other options.

The administration charge described above is intended to compensate SEMP for the costs incurred in delivering the items included in the membership pack (including shipping and postage) and other costs incurred by SEMP in connection with the membership.

If a member fails to return a completed refund/credit application form or their membership package by the required date, then the member will be taken to have waived their right to a refund/credit.  This is in acknowledgement that members may wish to allow SEMP to retain their membership fee despite the cancellation of the season in order to help fund SEMP's operating costs in a difficult operating environment.

Membership Refund/Credit Policy – should NBL24 be reduced or played without crowds

If SEMP plays less than 14 home games (excluding finals) in Victoria during the NBL24 season, being home games at which a crowd is permitted ('Crowd Attended Home Games'), then members will be entitled to a partial refund or partial credit of their membership fee provided they complete and return to SEMP, prior to 30 May 2024, a refund/credit application form (which form will be made available at https://www.semphoenix.com.au. This includes a partial refund of payments made via the Phoenix Flex Payment Plan.

The amount of the refund/credit will be calculated by SEMP having regard to the proportion of Crowd Attended Home Games played compared to the minimum number of games described above (being 14 home games).

SEMP may also deduct an administration charge of up to $20 for single membership or $50 for a family membership.  The administration charge is intended to compensate SEMP for the costs incurred in delivering the items included in the membership pack (including shipping and postage) and other costs incurred by SEMP in connection with the membership.

Membership Refund/Credit Policy – should NBL24 be delayed

If the NBL24 season is delayed but commences prior to 30 May 2024 and SEMP still plays at least 14 home games (excluding finals) in Victoria during the NBL24 season, being home games at which a crowd is permitted, then members will not be entitled to a refund or credit. 

Reserved Seating Membership

SEMP reserves the right to amend seating arrangements, including seating category configuration and pricing, at its sole discretion where necessary due to stadium build changes, seating plan changes, membership demands, venue changes, regulatory requirements or government restrictions (including government-imposed crowd restrictions) or any other reason.

Members will be notified if there has been a change to their seating. All seating changes will be kept to a minimum and where reasonably possible SEMP will keep affected members in a comparable seat (having regard to the reason for the seating relocation).  SEMP reserves the right to issue refunds where it determines, in its sole discretion, that alternative seating arrangements are not possible.

Subject to any rights that the membership holder may have under the Australia Consumer Law that cannot lawfully be excluded, SEMP will not be liable for any loss or damage suffered by the membership holder or any other person arising out of or in connection with a change to a membership holder's seating.

stadium/venue entry

Membership rights are subject to the terms of entry of the stadiums home games are played at, which can be accessed via venue websites.

Indemnity

In purchasing this membership you agree to indemnify SEMP and its officers, employees and agents ('The Indemnified') against any loss, cost, expense, liability or damage, including without limitation any personal injury or death, suffered or incurred by any of The Indemnified arising out of any act or omission by you or your Transferee. Your liability will be reduced to the extent that the applicable loss, cost, expense, liability or damage arises from a negligent act or omission of SEMP.

Consumer Law

Nothing in these terms and conditions is intended to limit or exclude any rights of members under the Australia Consumer Law that cannot lawfully be excluded.

Changes

SEMP may, in its sole discretion, amend these terms and conditions where reasonably required in order to accommodate any changes that are announced by the NBL in relation to the NBL24 Season. The amended terms and conditions will be sent by email to members.
